Terms of Service (Pre-Launch and Ecosystem)

1. Acceptance of Terms

Welcome to DREAMSTREAM Academy. By accessing or using our website, submitting your information to our waitlist, or accessing any content provided by us, you agree to be bound by these Terms of Service ("Terms").

These Terms apply to all visitors, users ("Parents," "Students," "Professionals"), and ecosystem partners ("Activity Providers," "Sponsors") who access the Service.

2. The DREAMSTREAM "Public Referral" Model

You acknowledge that DREAMSTREAM Academy operates on a "Direct-to-Consumer" model, distinct from traditional educational institutions.

• Not a School Official: Even if you were referred to us by a School, District, or Network Sponsor, DREAMSTREAM is a third-party vendor. We are not a "School Official" as defined by FERPA, and we do not maintain educational records on behalf of schools.
• Direct Consent: By using our services, you (the Parent/Guardian or eligible Student) are providing data and consent directly to DREAMSTREAM Academy, independent of your school affiliation.

3. Description of Service

Intended Future Services

Upon full launch, DREAMSTREAM intends to offer an ecosystem that facilitates:

• Career Pathing: Assessment tools and content to guide students toward career interests.
• Marketplace: A directory to browse and book educational experiences provided by third-party Activity Providers.
• Sponsorship Integration: Connections to opportunities funded or supported by Corporate and Community Sponsors.

4. Eligibility & Registration

• Age Requirement: You must be at least 13 years old to register.
• Users Under 13: Children under 13 may not register directly. A Parent or Legal Guardian must create the account and submit information on their behalf.
• Parental Responsibility: By registering on behalf of a minor, you represent and warrant that you are the parent or legal guardian of that child and consent to these Terms on their behalf.

5. Marketplace & Activity Providers Future Feature

Upon the launch of our marketplace features, the following terms will apply:

• DREAMSTREAM as Connector: DREAMSTREAM acts solely as a platform to connect families with third-party Activity Providers. We do not own, operate, or supervise the classes, workshops, or activities listed on the Service.
• No Liability for Delivery: You acknowledge that Activity Providers are solely responsible for the safety, quality, and delivery of their programs. DREAMSTREAM Academy is not liable for any injury, loss, or damage arising from your participation in an Activity Provider's program.
• Vetting Disclaimer: While DREAMSTREAM requests evidence of due diligence or background checks from Providers, we cannot guarantee the accuracy of this information or the safety of every external interaction. Parents are responsible for verifying the suitability of an activity for their child.

6. Payments Future Feature

• Processing: If you purchase services through DREAMSTREAM, payments will be processed via third-party payment processors (e.g., Stripe, PayPal). We do not store financial information.
• Refunds: Refund policies for specific activities are determined by the respective Activity Provider or as explicitly stated at checkout.

7. User Conduct

By using this site, you agree not to:

• Use the site for any unlawful purpose.
• Attempt to gain unauthorized access to our database or computer systems.
• Submit false or misleading information (e.g., impersonating another individual or misrepresenting your relationship with a minor).
• Harass, intimidate, or harm other users or partners within the ecosystem.

8. Intellectual Property

• DREAMSTREAM Content: The names "DREAMSTREAM Academy," "Stream Blue," our logo, the tagline "Intelligently Guided," and our underlying platform technology are the exclusive intellectual property of DREAMSTREAM Academy.
• Partner Content: Logos and course descriptions provided by School, Community, or Corporate Sponsors and Activity Providers remain the property of their respective owners.
• Restrictions: You may not modify, publish, transmit, create derivative works from, or exploit any of the content without express written permission.

9. Third-Party Links and Tools

Our Service may contain links to third-party websites or services (such as assessment tools, labor market data sources, or Sponsor websites) that are not owned or controlled by DREAMSTREAM Academy. We assume no responsibility for the content, privacy policies, or practices of any third-party websites.

10. Disclaimer of Warranties

We make no warranty that:

• The Service will meet your specific requirements.
• The results obtained from using the Service (e.g., career assessments) will be accurate or reliable.
• The quality of any products, services, information, or other material purchased or obtained by you through the Service (including from Activity Providers) will meet your expectations.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall DREAMSTREAM Academy, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States of America and the State of Delaware, without regard to its conflict of law provisions.

13. Changes to Terms

DREAMSTREAM Academy reserves the right to modify these Terms at any time, particularly as our product evolves from Pre-Launch to Full Availability. We will notify users of significant changes by updating the date at the top of this page.
